Affiliate Agreement

1. Affiliate Revenue

Affiliate partners are entitled to 30% of the recurring revenue generated from customers referred to the platform via their unique affiliate link.

2. Affiliate Tracking

Affiliate tracking is managed through a third-party software provider, Trackdesk. ReelMagic is not responsible for any errors or issues arising from the use of Trackdesk.

3. Payment Terms

Affiliate payments will be made on a monthly basis. There are no restrictions on the duration for which recurring revenue will be paid to the affiliate, as long as the referred customers continue to generate revenue. Affiliates must reach a minimum payout threshold of $16 USD before commission payments are issued. If the threshold is not met, commissions will be carried over to the next payment cycle.

4. Limitations of Liability

ReelMagic shall not be held liable for any issues, including but not limited to payment failures, loss of funds, or data loss, resulting from Trackdesk's operations or any technical errors. In the event of any disruptions that affect payment to affiliates, ReelMagic disclaims any responsibility for the loss of funds.

5. Agreement Modifications

ReelMagic reserves the right to modify this agreement at its discretion. Reasonable efforts will be made to inform affiliates of any changes; however, it is the affiliate's responsibility to review the terms regularly.

6. Affiliate Responsibilities

Affiliates must comply with all applicable laws, regulations, and ReelMagic's policies when promoting the platform. This includes, but is not limited to, accurately representing the services offered and avoiding any false or misleading claims.

7. Prohibited Activities

Affiliates are prohibited from using any unethical or illegal marketing techniques, such as spamming, purchasing leads, or using unauthorized promotional methods to drive traffic to the platform. Violations may result in the termination of the affiliate agreement and forfeiture of unpaid commissions.

8. Commission Adjustments

ReelMagic reserves the right to adjust affiliate commissions in cases of fraud, chargebacks, or cancellations by customers. If a customer cancels their subscription or requests a refund, the affiliate commission related to that sale may be revoked or adjusted.

9. Termination

Either party may terminate this agreement at any time. Upon termination, the affiliate will no longer earn commissions from any future revenue generated by referred customers. However, existing recurring commissions may continue based on the terms outlined in this agreement.

10. Intellectual Property

Affiliates are granted a limited, non-exclusive right to use ReelMagic's trademarks, logos, and marketing materials for the sole purpose of promoting the platform. Any misuse of intellectual property may result in termination of the affiliate agreement.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which ReelMagic is headquartered. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Non-Transferability

The rights and obligations under this agreement may not be transferred, assigned, or sublicensed to any third party without ReelMagic’s prior written consent.
